Terms & Conditions: Introductory provisions
René Melichárek is the owner of this e-shop in addition to being a Retailer.
These Terms & Conditions are applicable when ordering goods from the e-shop at www.gasbottlesdirect.com.
The Seller delivers the goods on the basis of an electronic order with the Customer's specifications and subsequent confirmation by telephone.
II. Terms of Delivery
Considered as the location of performance is the address of the Buyer that is specified on the order form.
Entitlement to the goods passes to the Buyer on the date of the delivery of the goods and of the payment for them.
Provided that they are in stock, the Seller shall deliver the goods ordered within 7 working days, but in any case no later than 30 working days subsequent to the receipt of a valid order in his electronic mailbox. Should the Seller fail to deliver the goods to the Buyer during this extended period of 30 working days, the Buyer is entitled to withdraw from the contract.
Goods ordered by mail are dispatched throughout the entire area of the Czech Republic in the form of Commercial Parcels either through Česká pošta (the Czech Postal Service) or a commercial delivery service.
III. Terms of Payment
All prices are inclusive of VAT. The tax is calculated is detailed in the purchase order. The purchase price of the goods is payable against delivery. The goods remain the property of the Seller until their payment in full. The Buyer pays for the goods before shipping.
Should the Buyer fail to accept the subject of performance for reasons on his/her side (for example, due to inability to pay the purchase price), the Buyer shall be responsible in full for the cost associated with the repeated delivery.
The fees for postage and packing are added to the purchase price of goods in the case of their delivery within the Czech Republic, based on the weight of the shipment:
0-4 kg - CZK 150; 5-19 kg - CZK 220; 20-29 kg - CZK 280; 30-39 kg - CZK 420; 40-50 kg - CZK 550
The following fees for postage and packing are added to the purchase price of goods in the case of their delivery to Slovakia, based on the weight of the shipment:
0-4 kg - CZK 300; 5-19 kg - CZK 500; 20-29 kg - CZK 750; 30-39 kg - CZK 850; 40-50 kg - CZK 950
The following fees for postage and packing are added to the purchase price of goods in the case of their delivery to Hungary, based on the weight of the shipment:
0-4 kg - CZK 600; 5-19 kg - CZK 980; 20-29 kg - CZK 1200; 30-39 kg - CZK 1400; 40-50 kg - CZK 1500
The following fees for postage and packing are added to the purchase price of goods in the case of their delivery to Germany, based on the weight of the shipment:
0-4 kg - CZK 600; 5-19 kg - CZK 980; 20-29 kg - CZK 1200; 30-39 kg - CZK 1430; 40-50 kg - CZK 1550
The Seller reserves the right to alter these prices. The Buyer pays the confirmed price for the order.
IV. Personal Data Privacy Policy
René Melichárek, as the operator of the www.gasbottlesdirect.com server, guarantees the security of any data that you provide.
Should the Buyer be acting as an individual, upon registration we require him/her to provide the following data:
First and Last Name
The address for delivery
An e-mail address
A contact telephone number
Should the Buyer be a legal entity, upon registration we require the provision of the following data:
Company Name
The address for invoices
The address for delivery
Business ID:
Tax Identification number
An e-mail address
A contact telephone number
This information is requisite for the identification of the Buyer. It is needed for conducting the requisite financial and accounting operations in regard to the payment for the goods purchased, for the proper delivery of the goods and for communication with the buyer.
The Buyer's personal information remains confidential and is not passed on to any third party. René Melichárek guarantees that he does not sell, rent or otherwise purvey this data to any third party.
By using the www.edive.cz e-shop the Buyer confirms his/her consent to the collection and utilisation of information concerning purchases made for the Seller's purposes.
V. Withdrawal from the contract by the Buyer
In accordance with Act No. 367/2000 Coll. of 14th September 2000 the Buyer is entitled to withdraw from the contract within a 14 day period from the receipt of the goods. Returns can be made based on the fulfilment of the following conditions:
The Buyer sends an email to reklamace@edive.cz (or to the postal address of the company) containing the text: "I wish to unilaterally withdraw from the contract of DD.MM.YYYY No. (order number) and I require repayment of the amount paid for the goods to be sent to the address (or the account number)………."; Date and Signature.
The Buyer shall return the goods to the address of the Company.
The goods must be returned in their original packaging, must not bear any signs of having been used, must be undamaged, intact and be accompanied by the original proof of purchase.
The costs of delivery are borne by the Buyer. The refund for the goods will be delivered to the Buyer through a transfer to his/her account within 10 working days following the actual receipt of the returned goods.
In the event of the failure to meet any of the above conditions the Seller will be unable to accept the withdrawal from the contract and the goods will be returned again to the sender at his/her expense.
The Buyer is not entitled to exchange the goods nor to a refund if the goods have been damaged in any manner by their improper use or treatment.
VI. Withdrawal from the contract by the Seller
The Seller reserves the right to cancel the order or any part of it in the event that the goods requested are no longer produced or cannot be delivered anymore or should there be a significant change in the cost of the goods from the supplier. In a situation of this nature, the Seller shall contact the buyer without undue delay in order to agree on what further action should be undertaken.
VII. Final Provisions
The Terms & Conditions defined on the website of the Seller as of the date of the sending of an electronic order shall be applicable unless the parties agree otherwise in writing. If the Buyer sends an order subsequent to the date on which a change in the Terms & Conditions has taken place, s/he is thereby agreeing with this change.
By submitting an electronic order the Buyer accepts, without reservation, all the provisions of the Terms & Conditions that are in force as of the date of the dispatch of the order, and also the prices of the goods ordered (including postage) valid as of the date of the dispatch of the order as listed in the price list on the website, unless, it is agreed otherwise in a specific instance. For the period specified for delivery of goods the Buyer is irrevocably bound by his/her dispatched order.
